Property Purchase Deposit Refunds in Turkey

Reviewing a failed Turkish property purchase: reservation payment, contractual deposit, seller authority and refund evidence.

Identify what the payment legally represents

A payment labelled deposit, reservation or kapora does not by its label decide whether it is refundable. Review the signed terms, who received the funds, why the transaction failed and any agreed withdrawal or forfeiture provision. Separate a seller from an agent or developer. A booking receipt is not a transfer of ownership; Turkish title registration is a distinct step.

Reconstruct the failed transaction

Keep the advertisement, contract, bank proof, promises, property identifiers and messages about cancellation. Record the payment currency and whether the recipient acted for the owner. Explain unmet conditions, such as a document that was not supplied, rather than simply stating that you changed your mind. Property-contract form requirements and the legal basis for refund need individual review.

Choose the claim against the correct party

A demand, negotiation, monetary enforcement or litigation may fit different circumstances. Consumer status, commercial character, mediation conditions and jurisdiction should be assessed. Do not assume a criminal complaint will itself recover a contractual deposit. For an overseas buyer, define the power of attorney and the scope of settlement authority. Recovery costs and the recipient’s available assets are separate from the amount claimed.

Questions about this procedure

Is every kapora automatically lost if the purchase fails?

No. The agreement, payment purpose, formal validity and reasons for failure determine the legal assessment.
