Turkish Inheritance Law and Legal Assistance

Turkish inheritance for foreign heirs: property, heirship certificates, wills, estate debts and tax filing. Av. Murat Adar, Istanbul.

THE SHORT ANSWER

An overseas resident or foreign national may have inheritance rights connected with Turkey. The deceased’s nationality, the location and type of assets, family records, wills and debts affect the route. Turkish immovable property is subject to a specific Turkish-law rule under Article 20 of Law No. 5718.

01

Build an estate map before distributing assets

List known land, apartments, bank relationships, company interests, vehicles and liabilities. Distinguish confirmed records from family assumptions. An inheritance certificate identifies heirship; it does not establish that a particular asset exists, reveal every debt or transfer every account automatically. Unknown assets can require separate, authorised enquiries. There is no unrestricted public database through which a lawyer can promise to find all assets in Turkey.

  • Record the date and place of death and all nationalities.
  • Identify relatives, changes of name and missing civil records.
  • Locate wills, earlier probate papers and any inheritance certificate.
  • List property identifiers, bank names and known liabilities.
02

Different assets can raise different legal questions

Article 20 of Law No. 5718 generally links succession to the deceased’s national law, while Turkish law applies to immovable property in Turkey. Other issues, including opening, acquisition and partition of the estate, have their own connecting rules. A foreign probate appointment or European document therefore should not be treated as automatic authority over Turkish property. Eligibility to hold land and registry restrictions must also be checked for a foreign heir.

03

Check debts and renunciation early

An estate can include liabilities as well as valuable property. Where Turkish renunciation rules apply, Article 606 provides a general three-month period, with the starting point depending on the person’s status and knowledge. Special circumstances can change the analysis. Acts involving estate property may affect the right to renounce. Before selling, withdrawing money or acting as owner, seek advice on the estate’s financial position and the deadline. Merely living overseas does not suspend every legal time limit.

04

From heirship to usable ownership

The practical sequence may include recording the death, proving family links, obtaining an inheritance certificate, investigating assets and debts, addressing tax formalities, registering property and arranging distribution. A dispute about heirship, a will, lifetime gifts or possession may require a separate claim. Co-heirs should not assume that one heir can sell the whole property. Agree representation and authority in writing, and distinguish a lawyer’s mandate from authority granted by other heirs.

An asset-by-asset route for heirs outside Turkey

Start with the deceased’s identity, nationality at death, death record, family relationship and any will. Then separate land, bank accounts, company interests and liabilities. The heirship document establishes entitlement; it does not establish the existence or value of every asset. A foreign probate or succession instrument must be assessed for its actual legal effect in Turkey.

From a certificate to registration or payment

For land, identify the parcel and registered owner before planning inheritance registration or sale. For a bank, the account relationship and the bank’s release requirements must be established. Tax filing, registry transactions and distribution are separate steps. Consider estate debts and any renunciation issue before making decisions about receiving or disposing of estate assets.

Example of an overseas family file

An heir living in Germany may hold a death record, a family record and an old Turkish deed. The first task is to connect the family identities and check the present title; the old deed is a lead, not proof of today’s ownership. The next work package can be heirship, asset enquiries or a dispute, depending on what those records show.

Turkish inheritance law for foreigners: which law applies?

Under Article 20 of Law No. 5718, succession generally follows the deceased’s national law; Turkish law governs immovable property in Turkey. Rules about the grounds for opening succession, acquisition and partition follow the law of the country where the estate is situated. Identify each asset and the deceased’s nationality before applying an inheritance share. A foreign heir’s own nationality does not alone select the succession law. Jurisdiction is separate: Article 43 points to the deceased’s last domicile in Turkey, or, if there was none, the location of estate assets in Turkey.

Inheritance rights of foreign spouses

When Turkish succession law applies, Civil Code Article 499 gives the surviving spouse one quarter with descendants, one half with the parental line, and three quarters with grandparents and their children; without those relatives the spouse takes the entire estate. Foreign nationality alone does not remove spousal status. Confirm the marriage and any divorce judgment. A matrimonial-property claim must be resolved separately from the spouse’s inheritance share: first determine what belonged to the deceased. Wills, reserved shares and challenges can affect the outcome.

Turkish certificate of inheritance and probate procedures

Civil Code Article 598 provides for a certificate of inheritance (mirasçılık belgesi or veraset ilamı). Under Notary Law Article 71/B, a notary cannot issue it when requested by foreigners, when civil records are insufficient or when adjudication is needed; the civil court of peace (Sulh Hukuk Mahkemesi) is the relevant court route. A foreign probate grant or certificate is not automatically a Turkish land-registration document. TKGM’s guidance requires a Turkish court certificate or a foreign competent-authority certificate confirmed by a Turkish court for foreign individuals. The necessary judicial procedure depends on the foreign document’s legal character. The English word probate describes a group of estate procedures, rather than a single identical Anglo-American process.

Inheritance tax, transfer and representation for non-residents

The tax return, land registration, bank release and distribution remain separate steps. A non-resident can instruct a Turkish inheritance lawyer with authority matching the work, while the receiving institution may impose identity or attendance requirements. Start with the death record, identity and family records, wills, known asset details and any overseas proceedings. Use the existing tax-filing guide for location-based return deadlines and the property guide for title transfer. A will-validity action, reserved-share reduction claim, heirship challenge and partition dispute require different remedies and deadline calculations.

Foreign wills, reserved shares and disputes between heirs

A foreign will must be examined for form, testamentary capacity and the applicable succession law. MÖHUK Article 20(4) refers to Article 7 and also accepts form complying with the deceased’s national law; capacity follows nationality when the will was made. An apostille authenticates the public document, not the validity of every disposition. Producing a will, opening it and obtaining a Turkish court decision on its effect are different tasks. Where Turkish law applies, protected heirs and reserved shares under Civil Code Articles 505–506 can limit testamentary freedom. A reduction claim, annulment of a will, heirship challenge and partition action require their own grounds and deadlines. Unequal treatment alone does not establish that a disposition is invalid.

Estate debts, bank accounts and renunciation of inheritance

Obtain statements of known estate debts as well as assets. The bank will require evidence of death, heirship, identity, tax compliance and representation appropriate to the proposed release; one heir’s certificate does not authorise disposal of every heir’s interest. Turkish Civil Code Articles 605–606 provide a renunciation route, generally within three months with a starting point depending on the heir’s status and knowledge. Conduct going beyond permitted estate management can affect that option. Insolvency, official liquidation and effects on descendants require separate advice before withdrawing funds or selling assets.

Tax filing obligations for heirs living abroad

Inheritance and transfer tax is separate from heirship and land registration. Filing may be required even where the inheritance falls below an exemption. The statutory filing window depends on the place of death and the heir’s location: the ordinary death-related cases use four, six or eight months, rather than one universal overseas deadline. Supply those facts and the asset inventory before calculating the date. Use the Revenue Administration’s current guidance for exemptions, valuation and payment; no fixed tax rate or exemption from a previous year should be assumed.

For a UK or US estate: separate the foreign appointment from Turkish asset work

Prepare an asset schedule that records the country, asset type, registered owner and supporting document for each item. A grant, executor appointment or trust document should be reviewed for the precise Turkish step; it is not a substitute for every Turkish heirship, bank or land-registry requirement. Include the deceased’s nationalities and any previous names before requesting translations.

A useful first-review deliverable

The initial review should identify missing evidence, the likely Turkish steps, who can instruct the work and which expenses need separate estimates. Ask whether the scope covers only heirship documentation or also estate enquiries, bank procedures, a dispute between heirs and a later sale. Legal fees, taxes, official fees, translation and delivery should be distinguished in the written scope.

FREQUENTLY ASKED QUESTIONS

Your questions, answered.

Can a foreigner inherit property in Turkey?+

Foreign nationality does not by itself exclude inheritance. Applicable succession law, proof of heirship and restrictions affecting the acquisition or retention of land need separate review.

Does a foreign probate document transfer Turkish property?+

Do not assume so. The document’s legal character and the Turkish procedure must be assessed; further evidence, recognition or a Turkish inheritance certificate may be needed.

How long does an inheritance case take in Turkey?+

An uncontested document application differs substantially from a dispute involving missing heirs, foreign law, assets or a contested will. The file must be reviewed before giving a realistic estimate.
