THE SHORT ANSWER

A person involved in Turkish criminal proceedings should have the allegations, procedural status, defence rights and urgent deadlines reviewed. A lawyer may assist with file access and representation within the applicable rules. A criminal defence enquiry is not a guarantee of release or a substitute for emergency assistance.

For immediate danger or emergency medical help in Turkey, call 112. This website does not promise a continuously staffed emergency line.

01

In an urgent situation, keep the first information short

For detention or an immediate questioning request, tell the lawyer where the person is, which authority is involved, the known allegation and whether questioning or a hearing is imminent. If someone is in immediate physical danger or needs emergency medical care in Turkey, contact 112. Do not wait for an online form response. Lawyer availability must be confirmed; this website does not promise a continuously staffed emergency line.

  • Identify the police, gendarmerie, prosecutor or court location.
  • State whether the person is detained, summoned or subject to an order.
  • Give the next known procedural time, without guessing.
  • Tell the lawyer if an interpreter or medical assistance is needed.
02

Defence rights and language access

Criminal procedure provides rights concerning information about allegations, legal assistance and interpretation where the conditions apply. Ask to understand the record before signing it. A person’s foreign nationality does not remove procedural safeguards. Consular communication may be relevant, but consular staff and a defence lawyer perform different roles. The lawyer must assess access to the file and any lawful restriction on disclosure.

03

Different forms of restriction need different responses

Being taken into custody, pre-trial detention ordered by a judge, judicial control and an arrest warrant are not the same. The basis of the decision and available challenge must be identified from the actual record. A travel restriction may continue even if the person is not in prison. Do not assume that a flight booking or a foreign address cancels a legal obligation to appear. Obtain case-specific advice before travel.

04

Protect the file and avoid speculative explanations

Preserve existing documents and correspondence without deleting, altering or coaching evidence. Do not publish sensitive allegations or witness details online. A defence is prepared from the actual file, lawful evidence and the person’s account, not from a promised outcome. Medical needs, interpretation, service and attendance should be addressed early. The criminal and immigration consequences of an event may require separate assessments.

Read the code through the actual procedural stage

Law No. 5271 regulates the criminal process. For practical purposes, distinguish investigation by the prosecutor, court proceedings after the relevant charge stage, interim measures, judgment and remedies. The right to counsel and the rules for questioning require attention to the person’s status and the act being performed. Article 147 concerns questioning safeguards; Article 202 addresses language assistance in its applicable circumstances. A general explanation cannot identify every remedy period without the decision and service date. Ask for the full document rather than a summary that says only the case is criminal. For foreign clients, translation, consular contact and the impact of an interim travel measure should be assessed alongside defence. Criminal limitation, objection to an interim measure and appeal from a judgment are different legal questions. The correct code provision must be matched to the actual issue and current text.

Is custody identical to detention ordered by a judge?

No. The authority, legal basis, duration and remedy must be identified for each measure.

Identify the status and immediate procedural act

A summons, custody record and detention order concern different stages. Establish the authority, location, file number, allegations and next hearing or remedy. A defence lawyer and interpreter have different roles; language assistance must be addressed with the competent authority. File-access restrictions may apply depending on the investigation.

Foreign nationality does not remove defence rights or guarantee release. Consular communication is separate from representation. The first instruction should identify what can be done at the current stage, the relevant decision and the deadline. Counsel’s representation does not automatically replace every personal-participation requirement.

Questions about this procedure

Does consular contact replace a defence lawyer?
