Separate procedural representation from special powers
A general mandate is not a reason to assume every act is authorized. Turkish civil procedure identifies acts that require specific authority, including particular waivers and settlements. Family matters and property transactions can raise additional form or wording requirements. Start from the intended task and confirm what the lawyer needs to do, rather than copying an unrelated internet specimen.
Make asset and settlement instructions explicit
Explain whether the work is limited to reviewing records, applying for heirship, litigating, collecting funds or selling a property. Authority to obtain a document is not automatically authority to dispose of an asset. Determine any payment-account instructions and who approves a compromise. The formal instrument and the engagement’s limits should fit together; discuss any restriction that could prevent the intended procedural act.
Review the draft before the overseas appointment
Consular and local notarial routes have different documentary requirements. Nationality, language, photos and the intended transaction may affect preparation. Check the receiving authority’s requirements and any apostille or legalization route first. An apostille cannot repair missing special powers. Retain a full copy and establish how originals, changes or revocation will be communicated to counsel and relevant institutions.
Questions about this procedure
Does an apostille fix insufficient authority?
No. It authenticates the relevant signature or seal within the Convention’s scope; the mandate’s wording and substantive authority still need review.

Identify decisions with independent consequences: settlement, waiving or accepting a claim, particular remedies, collecting money and disposing of an asset may need express treatment. The exact scope is governed by the instrument and applicable rules, not by an informal description such as full authority. Ask which powers the lawyer needs now and which can remain outside the mandate. For a company client, verify that the signatory can grant the relevant authority on behalf of the entity. If the mandate is executed abroad, prepare corporate and identity evidence along with the notarial text and formal chain. Consider whether instructions on payment destinations or settlement approval should also be recorded in the engagement. A properly granted special power can have consequences even if the client informally thought the lawyer would ask again. The instrument and the working arrangement should therefore be consistent.
Is a broadly worded power always better?
No. The useful scope is the authority needed for the agreed work, with the form and special powers appropriate to the act.
