THE SHORT ANSWER

Property information must be obtained through a lawful access route and matched to the precise parcel, unit or interest in question.

01

Start with reliable identifiers

A postal address or estate advertisement may not identify the registered unit accurately. Provide parcel, block, independent-unit or title information if lawfully held. Current records and historical transfers answer different questions. State whether the purpose is a purchase, inheritance, dispute or document use abroad.

02

Understand the limits of the record

Registry information does not necessarily establish physical condition, market value or every planning issue. Access may require a legal interest and suitable authority. A lawyer cannot promise unrestricted access to another person’s complete property holdings. The report should identify the date, scope and any unanswered enquiry.

03

Access is an entitlement, not a promise

Court files, civil records, banking information and land registry information are governed by different access rules. A lawyer’s professional status does not provide unrestricted access to every record. Some applications require a power of attorney, a party connection, heirship evidence or a court decision. If a document cannot legally be supplied, the answer should say so and explain any lawful alternative rather than imply an official connection.

04

Keep sensitive material out of the first enquiry

A short description, record type, country of use and deadline are usually enough to identify a starting point. Do not send passwords, e-Devlet credentials, complete banking details, identity numbers or a full criminal file through the open enquiry form. Once scope and authority are agreed, a suitable document-exchange method can be established. Name differences across passports, marriage records and judgments should be disclosed because they can affect acceptance.

Choose the registry evidence the receiving institution needs

Specify whether you need an ownership record, a current restriction enquiry, evidence about a deceased person’s property or documents for a court file. These are different requests, and an old title copy may not answer a question about current ownership. Provide reliable property identifiers and explain your legal relationship to the record. The authority required to inspect information and the authority required to obtain a copy or undertake a transaction are not identical. A lawyer should identify the lawful access route rather than promise unrestricted searching of anyone’s property. For use abroad, ask the foreign recipient whether it requires a certified record, translation or authentication. Record the issuing institution and date so the recipient can assess currency. Fees for retrieving a document should distinguish official charges, translation and the legal work of interpreting the result.

Is an informal property listing enough for a title enquiry?

It is only a starting lead. Precise registry identifiers and a lawful basis for the request are needed to obtain and interpret the relevant records.

Can this process be handled while you live abroad?

Some records can be obtained through a representative; others require personal application, a particular legal interest or an institutional process. Electronic availability does not automatically mean a document is valid for every foreign use.
