What does habitual residence mean in a child case?
Habitual residence concerns the child’s real life before the relevant event and cannot be reduced to passport or a brief visit. Document home, care, school and social integration. Its legal significance depends on the particular jurisdictional or treaty question.

Legal context
Children and finances are separate workstreams, not automatic by-products of divorce.
Turkish courts assess custody and contact through the child’s interests and the facts of the case. A passport does not decide custody. Habitual residence, daily care, schooling, health, safety and each parent’s relationship with the child may matter. A cross-border removal or retention can also raise a separate Hague Convention return issue.
There is no universal fixed percentage for maintenance in Turkish law. The type of support, needs, resources, living conditions and evidence are assessed. Matrimonial property is mapped by regime, acquisition date, funding source, title and debt; Turkish and foreign assets may need different proceedings or enforcement measures.

What does the child’s best interests assessment involve?
The analysis concerns care, stability, safety, education, health and relationships, rather than a parent’s passport alone. Explain the child’s actual routine and existing arrangements. A parenting proposal should show how the child’s needs will be met in practice.
Nationality is one legal connection, not an automatic custody award. Distinguish jurisdiction from the merits and identify the child’s actual living situation. Holding a Turkish or foreign passport does not establish unrestricted authority to relocate the child across borders.
Specify dates, handover points, travel costs, documents and communication. Coordinate the plan with school terms and existing orders. Permission for a short visit should not be treated as agreement to permanent relocation; record the intended return clearly.
