Attachment protects a potential recovery
Precautionary attachment is a court measure concerning a monetary claim, not a private power to freeze the debtor’s property. The claim’s maturity, security and the statutory conditions matter. A suspicion that a debtor may not pay is not enough to promise an order. Counsel needs evidence of the claim and the circumstances relied on for the application.
Prepare the application and security assessment
Identify the debtor and lawfully known assets, and supply contracts, due dates, acknowledgments and payment records. The court assesses the evidence required for an interim measure rather than finally resolving every disputed fact. A security deposit may be required; exceptions and the amount depend on the legal basis and the court’s assessment. Costs should be distinguished from the principal debt.
An order requires timely follow-up
Implementation, objections and continuation through the main claim or enforcement have their own short procedural periods. A court order sitting in an email is not completed collection. Plan who will obtain and implement the order, how the main proceeding will continue and whether corporate authority is complete. Attachment cannot guarantee payment where competing creditors or insolvency affect the assets.
Questions about this procedure
Can the lawyer freeze assets immediately on request?
Only through the appropriate legal process if its conditions are met. Court assessment, implementation and procedural deadlines remain necessary.
