Agreement on divorce is only the starting point
A settlement should describe what each spouse must do, when and where. General statements such as “all matters are settled” can leave important questions unanswered. Separate the end of the marriage from maintenance, compensation, property and children. The legal effect of a clause and the route for enforcing it should be considered before signature.

Write payment terms that can be followed
Identify the creditor, currency, amount, payment date and method for every obligation. Address bank charges, recurring payments and the consequences of missed payment. When income and expenses are in different currencies, avoid leaving the conversion mechanism undefined. Do not assume a foreign payment order can be executed in Türkiye without examining the recognition or enforcement route.

Make the child arrangements practical
A parenting schedule should cover school days, holidays, travel costs, collection points and communication between parents. Cross-border travel and relocation raise separate questions; a vague contact clause should not be treated as unrestricted permission to move a child abroad. The court’s assessment of the child’s interests remains central even where the parents agree.

Separate title transfers from general promises
List each property or debt precisely and explain the intended transaction. A promise in a divorce protocol may still require a distinct registration, transfer or enforcement step. Check how the decision will be used in the other country, including translation and finality requirements. A settlement in one language should accurately convey the obligations understood by both spouses.
