Is one year of marriage required for every divorce?
The one-year marriage condition belongs to the consensual procedure under Article 166(3). It should not be turned into a blanket prohibition on all divorce claims during the first year. A different legal ground requires its own facts, evidence and procedure.

Uncontested and contested divorce follow different evidence and attendance rules.
An uncontested divorce under Article 166/3 requires a marriage of at least one year, a joint application or acceptance, freely expressed declarations before the judge and an approved arrangement covering the financial consequences and children. A signed protocol alone does not end the marriage, and a lawyer cannot replace the spouses’ personal judicial declarations.
A contested divorce requires material facts, a legally recognised ground, lawful evidence and precise requests. Interim arrangements for safety, the family home, children and maintenance should be considered at the beginning. A foreign address adds international service and often extends the timetable.

Must both spouses attend a consensual divorce hearing?
For the Article 166(3) consensual route, the judge must hear both spouses personally and assess their freely expressed agreement. Lawyer representation alone does not replace that requirement. Agree the hearing arrangements with counsel before booking international travel.
A spouse’s foreign address does not automatically prevent filing in Türkiye. Jurisdiction, applicable law and formal international service must be planned together. Provide the most accurate address available and distinguish the filing date from the completion of lawful notification.
Refusal to agree rules out relying on agreement alone; it does not automatically defeat every contested claim. The court examines the relevant grounds, facts and evidence. Identify what is disputed and avoid assuming that non-attendance equals consent.
For clients in the UK, the United States and other English-speaking countries, familiar labels can conceal different legal effects. A final divorce order, a financial order and a parenting arrangement should be identified separately. The place of marriage alone does not decide jurisdiction or the applicable law. Planning begins with the result required in Türkiye and the result required abroad.
