Inheriting Property in Turkey

THE SHORT ANSWER

Inheritance rights and registration of Turkish real estate are connected but separate steps. Establish heirship, review the title, consider liabilities and complete the appropriate registry and tax formalities.

01

Do not confuse a family understanding with registry ownership

Find the parcel and independent-unit identifiers if available. A relative may have occupied property without being its registered owner, or may have owned only a share. The estate may include a claim rather than title itself. Obtain lawful current information before promising a sale or distribution. Existing mortgages, attachments, tenancy and third-party rights should be considered.

02

Co-ownership affects the next transaction

Once the heirs and their interests are established, selling the whole property may require the relevant co-heirs’ agreement and suitable authority. If agreement is impossible, partition or other proceedings may be relevant. A foreign heir’s ability to acquire or retain land must be checked separately from the existence of inheritance rights. Plan signing, taxes and payment with the actual registry requirements in mind.

03

Different assets can raise different legal questions

Article 20 of Law No. 5718 generally links succession to the deceased’s national law, while Turkish law applies to immovable property in Turkey. Other issues, including opening, acquisition and partition of the estate, have their own connecting rules. A foreign probate appointment or European document therefore should not be treated as automatic authority over Turkish property. Eligibility to hold land and registry restrictions must also be checked for a foreign heir.

04

From heirship to usable ownership

The practical sequence may include recording the death, proving family links, obtaining an inheritance certificate, investigating assets and debts, addressing tax formalities, registering property and arranging distribution. A dispute about heirship, a will, lifetime gifts or possession may require a separate claim. Co-heirs should not assume that one heir can sell the whole property. Agree representation and authority in writing, and distinguish a lawyer’s mandate from authority granted by other heirs.

Title registration and foreign ownership are separate questions

Begin with the actual parcel or apartment record and confirm that it belonged to the deceased. Assemble death, family relationship and heirship records, any will and evidence explaining names used in different countries. Registration of inheritance must be distinguished from partition, sale and the foreign heir’s ability to retain the property under land-acquisition rules. TKGM’s official explanation separates succession registration from the subsequent assessment of foreign ownership restrictions. Do not treat a person’s nationality as automatic proof that no inheritance right can exist. Likewise, do not promise that every inherited property can be retained indefinitely. The title office, tax authority and any court can require different evidence. Where several heirs inherit together, registration does not by itself divide the property into individually disposable apartments. Explain mortgages, occupation and existing leases before deciding whether to hold, sell or seek partition. A power of attorney to investigate records is not automatically a sale mandate. Ask whether the quoted fee includes only registration or also negotiation, partition proceedings and completion of a later transaction.

Transferring inherited property at the Turkish land registry

Identify the title office, parcel and registered deceased owner. Prepare the heirship certificate accepted for the foreign heir, identity or passport, representation document if applicable and other documents required for the actual property. Court recognition or confirmation of foreign heirship evidence must be addressed before assuming it is usable. Tax filing and any clearance required for the proposed transaction should be coordinated with the registry; registration of inheritance does not automatically complete a sale or distribution. TKGM’s foreign-investor procedure guide lists representation and heirship evidence separately.

Foreign heirs and restrictions on retaining Turkish land

Succession entitlement and eligibility to retain the land are distinct. Nationality, restricted locations, statutory acquisition limits and any liquidation obligation require a current parcel-specific review under the Land Registry Law. Do not apply historic reciprocity rules as a universal modern requirement. Registration does not eliminate restrictions, and nationality alone does not establish whether this particular land can be retained. If co-heirs disagree, distinguish consensual partition or sale from judicial dissolution of co-ownership.

Can I sell the whole property using only my own heirship share?

Not automatically. Ownership form, other heirs’ rights and valid authority for the proposed disposal must be assessed.

Can this process be handled while you live abroad?

Many certificate applications, authorised enquiries and registry steps can be managed by a lawyer under an appropriate power of attorney. Court requirements, disputes and the formalities of a proposed sale may create additional steps.

FREQUENTLY ASKED QUESTIONS

Your questions, answered.

Can one heir sell the entire inherited property?+

Not merely because that person is an heir. The ownership structure, the other heirs’ rights and the authority to sell must be checked.

Can a foreigner inherit property in Turkey?+

Foreign nationality does not by itself exclude inheritance. Applicable succession law, proof of heirship and restrictions affecting the acquisition or retention of land need separate review.

Does a foreign probate document transfer Turkish property?+

Do not assume so. The document’s legal character and the Turkish procedure must be assessed; further evidence, recognition or a Turkish inheritance certificate may be needed.

How long does an inheritance case take in Turkey?+

An uncontested document application differs substantially from a dispute involving missing heirs, foreign law, assets or a contested will. The file must be reviewed before giving a realistic estimate.
