01 / LEGAL PREPARATION

Identify each policy layer before comparing the numbers

A serious accident may involve compulsory traffic insurance and additional voluntary liability cover known as İMM. Read the actual policies and endorsements rather than treating them as one unrestricted fund. Identify the insured person or vehicle, event period, covered liability, relevant limits and any conditions affecting how a layer responds. The claimed losses also need to be separated by category. A high aggregate demand does not mean every item engages every policy. The case map should identify which insurer is approached for which request and how an earlier payment is treated. This makes the relationship between the loss and the possible cover understandable before a decision is made about additional applications or claims against other responsible parties.

02 / LEGAL PREPARATION

The loss assessment and the limit assessment are different

First identify the documented loss and supporting calculation. Then examine the applicable cover and any limit issue. A policy limit is not a valuation of the client’s actual loss, and the loss calculation does not automatically establish an insurer’s full responsibility. The event date, policy wording, fault assessment, previous payments and competing loss items may all need consideration. If more than one person was affected by the accident, record their distinct claims and any available payment information. Avoid presenting a general figure from a current webpage as the answer to a policy issued for another period. The legal review should explain which limit or condition is being relied on, the documents supporting it and what remains outside or disputed under the particular policy.

03 / LEGAL PREPARATION

Check the conditions of the additional cover

Obtain the complete İMM policy material, including extensions and special conditions. Product summaries may omit a provision that matters to the request. Establish how the insurer says the cover interacts with compulsory traffic insurance and what evidence it requests. Separate a refusal based on a contractual condition from disagreement about the amount of the underlying loss. If a policy includes or excludes a particular category, read that wording in context rather than assuming that every voluntary policy is identical. Keep the insured party’s application and all insurer responses with the case chronology. The appropriate recipient and sequence of claims are determined from those actual documents. An additional policy should not be treated as a substitute for investigating liability, supporting the requested losses or checking procedural requirements.

04 / LEGAL PREPARATION

Build a payment and outstanding-loss register

For each payment, identify the payer, date, amount, loss category and settlement document. Show how it has been credited in the request directed to another policy or responsible party. A statement that the compulsory insurer has paid its limit needs supporting documents and a clear explanation of what was paid. If the same event includes vehicle damage and bodily injury, do not combine the records without explaining the categories. When another insurer disputes the remaining balance, identify whether it disputes loss, cover or the treatment of the earlier payment. A transparent register helps avoid overlap while making an actual outstanding issue visible. It does not assume that the full remaining figure must be paid under İMM; the additional contract and applicable legal assessment remain necessary.

05 / LEGAL PREPARATION

One accident can still require more than one route

An insurer’s policy responsibility and another person’s alleged liability may involve different requests and procedural paths. Identify the driver, vehicle operator, insured party and insurers instead of grouping them together as “the other side”. If arbitration is being considered against an insurer, its conditions require assessment and may not resolve every claim against those other persons. A settlement with one party should be read for its scope and implications before another request is pursued. The office can prepare a combined map showing applications, evidence, payments and remaining issues, then explain the appropriate sequence. This approach allows the client to understand what each step is intended to achieve without promising that additional cover automatically closes every gap in the accident loss.
