01 / LEGAL PREPARATION
The Guarantee Fund is not general accident insurance
Güvence Hesabı has a defined role under the applicable compulsory-insurance framework. Its official explanations distinguish eligible bodily injury situations from ordinary vehicle-damage demands and identify exceptions. A vehicle being uninsured or unidentified does not mean that every resulting loss is automatically paid by the Fund. Start by identifying the event, claimant, vehicle status and loss category. A request for car repairs should not be assumed to follow the same assessment as a request concerning injury or death. The circumstances involving an insurer’s failure may also require a different inquiry. Read the official scope information and the detailed Turkish guide for the actual case rather than using the Fund’s existence as a substitute for identifying the appropriate responsible party.
02 / LEGAL PREPARATION
Explain why the relevant vehicle status applies
An application needs evidence supporting the allegation that a vehicle was uninsured, unidentified or otherwise within the claimed situation. Keep the official incident or investigation material, available registration information, insurance enquiries and relevant correspondence. If the vehicle was not identified at the scene, record what information is actually known and which investigations were made. A recollection that a driver said there was no insurance is different from documented insurance status. The legal review should distinguish evidence, unresolved points and assumptions. Where later material identifies the vehicle or its policy, update the case map. The objective is to explain the actual institutional basis for the request, not to fit every accident into an initial description after new facts have become available.
03 / LEGAL PREPARATION
Bodily injury evidence remains essential
Where an eligible bodily injury claim is being assessed, the medical, income and incident evidence must still support the requested loss. Record hospital attendance, treatment, follow-up and the claimed effect on work or support. A question about which institution may be approached does not replace the need to demonstrate the loss itself. Keep the appropriate medical reports and previous payments with the chronology. If the case concerns a death, identify the persons claiming a loss of support and the supporting material. The proposed amount should be connected to documented inputs, not simply to the maximum cover described in an institutional notice. The appropriate calculation and legal assessment depend on the individual facts and evidence, even where the institutional route is established.
04 / LEGAL PREPARATION
A hypothetical uninsured accident file
Imagine a person injured in an accident who has an official incident record and medical treatment documents but incomplete information about the other vehicle’s policy. The initial file should separate the insurance-status enquiry from the medical chronology and the requested loss. The enquiry may clarify the appropriate insurer or show why the Fund route requires examination. If the person also has vehicle damage, that demand should be separately mapped rather than included without analysis in the bodily injury request. This is a preparation example, not a finding of eligibility. It illustrates why identifying the institution, proving the incident and supporting the claimed loss are distinct tasks that must be brought together in a coherent application.
05 / LEGAL PREPARATION
Record the application and any subsequent proceeding
Use the institution’s current document guidance and identify the request clearly. Keep the full application, attachment list, delivery record and any answer or request for additional material. Explain a missing document where appropriate and record efforts to obtain it. If the matter has already reached arbitration or a court, retain the file details and notifications rather than starting a second unexplained version of the same case. Costs, deadlines and available routes must be assessed for the actual procedural position. An initial discussion should establish what the institution has received, what it has decided and what remains disputed. The office can then review the appropriate next step without assuming that the existence of a Fund application guarantees an award, a particular amount or a payment date.
