THE SHORT ANSWER

An inheritance instruction should distinguish proof of heirship, asset enquiries, debt review, registration, distribution and disputes. These tasks can require different documents and authority.

01

Decide what you need the lawyer to establish

If you only know that a relative owned something in Turkey, begin with the deceased’s details and the source of that information. If an inheritance certificate already exists, explain whether you dispute the shares or need to use it. If another heir has possession, distinguish an accounting, a partition and a title issue. A single instruction to “get my inheritance” is too broad to define the work and costs.

02

Agree access, reporting and authority

The lawyer should explain which enquiries are legally available and what cannot be searched without further evidence or permission. Agree how results, missing records and costs will be reported. Authority to apply for a certificate is not always the same as authority to receive money, settle claims or sell property. Co-heirs’ interests may conflict, so representation should be clarified before sharing a full file.

Define the result of the inheritance instruction

Obtaining an heirship certificate, locating assets, transferring a property and litigating a disputed share are different instructions. Begin with what is known and what is contested. If another heir proposes a sale or distribution, provide the proposal and current ownership information before signing authority for a transaction.

How the work can be divided

A first phase can organise family evidence, nationality, documents and known assets. A second can pursue the appropriate certificate or authorised enquiries. A later phase can handle registration, release of funds, an agreement or litigation. Agree reporting, the scope of searches and which fees relate to which phase.

Authority for heirs abroad

Authority to obtain records is different from authority to receive money or sell property. The wording should identify the intended work and any necessary special powers. Joint representation depends on the actual interests of the heirs; one heir should not assume that a lawyer instructed by another represents everyone.

FREQUENTLY ASKED QUESTIONS

Your questions, answered.

Will the lawyer automatically locate all assets?+

No. Searches depend on legal access, identifiers, authority and the information held by the relevant institutions.

Can a foreigner inherit property in Turkey?+

Foreign nationality does not by itself exclude inheritance. Applicable succession law, proof of heirship and restrictions affecting the acquisition or retention of land need separate review.

Does a foreign probate document transfer Turkish property?+

Do not assume so. The document’s legal character and the Turkish procedure must be assessed; further evidence, recognition or a Turkish inheritance certificate may be needed.

How long does an inheritance case take in Turkey?+

An uncontested document application differs substantially from a dispute involving missing heirs, foreign law, assets or a contested will. The file must be reviewed before giving a realistic estimate.
