International Child Return and Turkey: Preparing a Hague Application
Distinguish a Hague return application from custody proceedings and prepare the chronology, residence evidence and cross-border documents.
Return and custody answer different questions
The 1980 Hague Convention addresses wrongful removal or retention and return to the country of habitual residence. It does not determine final custody. Check the child's age, the relevant countries and whether the Convention operates between them. Nationality alone does not establish habitual residence. Turkey's Central Authority is the Ministry of Justice department listed by HCCH.
Explain what changed and when
Create a dated chronology of daily life, care arrangements, travel permission, the planned return and the first refusal to return. Distinguish consent to a holiday from consent to permanent relocation. Keep school and care records, identity documents, complete messages, travel records and existing orders together. Identify what each item proves instead of sending disconnected screenshots.
Assess timing and possible objections
The Convention's one-year period is not an automatic bar to making an application. Consent, acquiescence, serious risk and a sufficiently mature child's objection may need careful examination. Record the facts supporting and challenging each issue. A return outcome or completion date cannot be promised from a short account of the dispute.
Coordinate the cross-border file
Separate assistance through the Central Authority, court proceedings and any existing custody case. Obtain complete decisions and identify their present status. Prepare the required translations and representation documents for the specific procedure. Keep requests concerning the child's immediate circumstances visible in the chronology rather than treating them as an unrelated attachment.
Questions
Does my custody order guarantee return?
No. A custody order is relevant evidence, but the return requirements and applicable treaty relationship must be assessed separately.
