Clinic, doctor or intermediary: who is responsible?
Clinic, doctor or intermediary: who is responsible?. Practical preparation for a Turkish legal claim when you live abroad.
Map the promises and payments
List who advertised, contracted, received money, performed the intervention and arranged aftercare. A package including transport or accommodation does not make all providers liable for every aspect. Record each separate promise and which person or company made it.
Medical and booking obligations
An alleged clinical error differs from misleading booking information, unprovided accommodation or a refund promise. The doctor’s medical duties and an intermediary’s own contractual representations should be supported by different records. The legal route depends on the facts and parties.
Documents to request
Keep booking terms, the invoice, bank recipient, messages identifying the practitioner, medical records and aftercare arrangements. A business social-media name may be insufficient to identify the proper defendant. Where different companies appear, explain the sequence rather than treating them as interchangeable.
Illustrative example
A booking agent promises a specific surgeon but the clinic appoints someone else. Relevant issues may include the booking representation, consent and actual practitioner. A single payment to the agent does not itself answer every liability question. Each alleged breach and resulting loss needs to be identified.
