Defective goods, repairs and refunds

Remedies for goods that do not match the contract or advertised qualities.

English centre / Defective goods, repairs and refunds

How the issue is assessed

A defect may concern performance, quantity, safety or qualities promised by the seller. Consumer remedies can include returning the goods and rescinding the contract, a proportionate price reduction, free repair or replacement, subject to the applicable conditions. A seller cannot automatically restrict every claim to repair. The feasibility and proportionality of a chosen remedy and the responsibility of other parties must be assessed.

Documents to prepare

Invoice, delivery date, advertisement screenshots, photographs, repair reports and written notices.

Key distinctions and deadlines

The general limitation period for defective consumer goods is two years from delivery. A defect appearing within the first six months is generally presumed to have existed at delivery unless inconsistent with its nature. Second-hand goods, longer guarantees and concealed defects require separate analysis.

Preparing a focused claim

  1. Record what was promised, what happened and the dates of each event.
  2. Identify the legal person named in the agreement and the recipient of payment.
  3. Preserve the original records and organise exhibits in date order.
  4. State the requested remedy and explain each item in the amount claimed.
  5. Check jurisdiction and deadlines before filing; a message to a business does not automatically stop procedural time limits.

Committee or court?

For a qualifying consumer dispute in 2026, the committee threshold is below TRY 186,000. At or above this amount, assess the consumer court route, mandatory mediation and statutory exceptions. The classification of the transaction must be established first; private sales and public healthcare disputes can require a different route.

Can I act from abroad?

Discuss representation, service of documents and the necessary power of attorney. Where documents are in another language, the translation requirements depend on the intended filing. Avoid assuming a website inquiry is a formal application.

How legal assistance works

A consultation can examine the contract, chronology, evidence and possible remedies. Representation and any expert or translation costs are agreed for the actual scope of work. Sending an inquiry does not itself create representation or file a claim.
