English centre / The 14-day withdrawal right
How the issue is assessed
For qualifying distance contracts, the general withdrawal period is 14 days without a reason or penalty. It normally starts on delivery for goods and conclusion of the contract for services. Notice should be made in writing or on a durable medium. Exceptions must be checked, including customised goods, certain perishable products and specified services. Buying in a physical shop does not create the same general change-of-mind right.
Documents to prepare
Contract, pre-contract information, delivery record, dated withdrawal notice and return tracking.
Key distinctions and deadlines
Under the Ministry’s current guidance, return and repayment dates must be tracked separately. Goods should generally be sent back within 14 days of withdrawal notice. Repayment timing depends on dispatch or receipt of the return, the carrier used and whether the goods were delivered. Defect claims are not confined to the withdrawal period.
Preparing a focused claim
- Record what was promised, what happened and the dates of each event.
- Identify the legal person named in the agreement and the recipient of payment.
- Preserve the original records and organise exhibits in date order.
- State the requested remedy and explain each item in the amount claimed.
- Check jurisdiction and deadlines before filing; a message to a business does not automatically stop procedural time limits.
Committee or court?
For a qualifying consumer dispute in 2026, the committee threshold is below TRY 186,000. At or above this amount, assess the consumer court route, mandatory mediation and statutory exceptions. The classification of the transaction must be established first; private sales and public healthcare disputes can require a different route.
Can I act from abroad?
Discuss representation, service of documents and the necessary power of attorney. Where documents are in another language, the translation requirements depend on the intended filing. Avoid assuming a website inquiry is a formal application.
How legal assistance works
A consultation can examine the contract, chronology, evidence and possible remedies. Representation and any expert or translation costs are agreed for the actual scope of work. Sending an inquiry does not itself create representation or file a claim.
