TURKISH CRIMINAL LAW · AV. MURAT ADAR

Foreign nationals, interpreters and consular assistance

Language support, consular contact and defence representation serve different functions in a Turkish criminal proceeding.

Explain the language difficulty

Tell the authority if you cannot adequately understand Turkish. The procedural rules address interpretation for relevant participants and stages. The need for interpretation should be made clear before an account is recorded or a document is signed. An English speaking friend does not necessarily fulfil the role of an officially appointed interpreter.

Communicating with the lawyer

An interpreter appointed for proceedings and interpretation needed for private legal consultations are different arrangements. Confirm the language of the consultation and any translation costs in advance. Written translations may be needed for detailed document review. The English website provides information but should not be taken as a promise that every appointment will proceed without interpreting assistance.

Consular contact

Foreign nationals may request contact with their country’s consular authorities through the applicable arrangements. Consular services may assist with welfare and family communication depending on their rules. They do not act as the defence lawyer and cannot determine the outcome of the criminal case or override a Turkish judicial order.

Immigration and criminal proceedings

A criminal matter can coexist with residence or immigration issues, but the procedures are separate. Release in a criminal case does not conclusively resolve every immigration question. Provide any residence, removal or administrative detention documents as separate records. The appropriate challenge and deadlines must be identified for each decision.

What to have ready

  • Full case number and the authority handling the matter
  • Your procedural role and current country of residence
  • Original decisions and notification or service records
  • A dated timeline and the evidence already available
  • Known hearing dates, travel plans and your questions

Common questions

Can my consulate represent me in court?

Consular assistance does not replace representation by a lawyer.

Is immigration detention the same as criminal remand?

No. Their authorities, legal grounds and remedies differ.
