TURKISH CRIMINAL LAW · AV. MURAT ADAR

Witness summons and giving evidence

A witness summons should be read for its issuing authority, date and requirements. Witness status is different from being a suspect or defendant.

Check the document

Confirm the court or prosecutor’s office, case number, scheduled appearance and instructions. Tell the lawyer whether you received the document personally or learned about it from another person. Do not assume that a foreign address cancels a summons. Any issue with attendance should be raised through the appropriate procedure.

Direct knowledge and uncertainty

A witness should distinguish personal observation from information supplied by someone else. If you do not remember a detail, do not replace it with a guess. Dates, documents and earlier statements can help refresh an accurate account. The purpose of preparation is to understand the process and organise facts, not to construct evidence.

Language and statutory exceptions

Explain any inability to understand Turkish adequately. Certain statutory situations may affect an obligation to testify or answer particular questions, including matters relating to family relationships or self incrimination. These exceptions depend on the precise circumstances and should be checked before relying on them.

If your position changes

A witness may have concerns that questioning concerns their own conduct. The procedural role and rights should be clarified if that occurs. Provide prior statements and any new notification to the lawyer. Advice suitable for a witness cannot automatically be transferred to a suspect interview.

What to have ready

  • Full case number and the authority handling the matter
  • Your procedural role and current country of residence
  • Original decisions and notification or service records
  • A dated timeline and the evidence already available
  • Known hearing dates, travel plans and your questions

Common questions

Can I simply ignore a summons?

The consequences depend on the document and applicable rules. Have any attendance difficulty assessed promptly.

Should I repeat something I heard as if I saw it?

No. Clearly distinguish the source of the information and your own knowledge.
