Turkish Divorce Certificate: Final Judgment and Certified Copies

How to obtain a Turkish divorce judgment, evidence of finality and civil registration records, and prepare the correct documents for use abroad.

Identify the document the receiving authority wants

“Turkish divorce certificate” can refer to different documents in an overseas application. A court divorce judgment establishes what the court decided; an endorsement or separate record of finality confirms its procedural status; a civil registration extract records the registered family status. Ask the receiving authority which documents it requires before arranging translation or certification. One document should not be substituted for another simply because both mention divorce.

Start with the court and case reference

For a divorce granted by a Turkish court, keep the court name, case number, decision number and the parties’ identity details. An eligible party or authorised lawyer can request the appropriate certified judgment and finality documentation from the issuing court registry. Access through UYAP depends on identity, account access and entitlement to the case; finding an electronic image is not always equivalent to obtaining the certified format required overseas.

Check finality separately from the hearing date

The hearing at which divorce is announced, the written judgment, service on the parties and finality are separate steps. Confirm that the document carries the relevant finality record rather than assuming that an old hearing date proves finality. If an appeal is pending, identify which parts of the decision remain disputed. A proposed remarriage or immigration filing may require proof of final status rather than merely a copy of the first decision.

Apostille, legalisation and translation

The destination country and receiving authority determine the presentation requirements. Where the Apostille Convention applies, an apostille authenticates the origin of a qualifying public document; it does not confirm that the divorce is recognised abroad or that a translation is sufficient. Check whether the judgment, finality attachment and apostille must all be translated. Preserve names, dates and references consistently across the complete document package.

A divorce granted outside Turkey is a different file

If the divorce was granted by a foreign authority, the foreign decision and Turkish civil registry status may not yet match. Turkish administrative registration or judicial recognition/enforcement may be required depending on the requested effect and statutory conditions. Do not request a Turkish court decree for a case that was never decided by a Turkish court. First identify the issuing authority and the procedure already completed in Turkey.

A practical document request

Provide the issuing court and case reference, names as recorded in the judgment, the country of intended use, the receiving authority’s checklist and any approaching deadline. Specify whether a certified judgment, proof of finality, civil registry extract or all three are required. This allows the request to focus on the actual document instead of an ambiguous generic “certificate”. Delivery time depends on the records and certifications required.

Frequently asked questions

Is a civil registry extract the same as a divorce decree?

No. It records civil status, while the court judgment records the judicial decision. The receiving authority determines which is needed.

Does an apostille make my divorce recognised everywhere?

No. An apostille concerns document authentication. Recognition of the legal effect is a separate question.

Can I obtain a document through a lawyer?

An authorised lawyer can assist within the authority granted and the applicable access rules.
