Turkish law protects the family home through specific Civil Code rules and allows temporary measures during divorce. Procedural injunctions may also preserve a defined right where statutory conditions are shown. None of these mechanisms automatically transfers ownership or freezes every asset; the measure must match the right and risk relied upon.

The family home is more than a title question

Article 194 regulates important transactions concerning the family home and includes mechanisms intended to protect the non-title-holding spouse. Whether a property qualifies depends on its actual family use and the circumstances, not merely the address printed on an identity record.

Ownership, occupation, a family-home annotation, rent and mortgage obligations should be documented separately. The protection sought must correspond to the legally relevant transaction or use problem.

Temporary use while divorce is pending

Under the interim-measures framework, the judge may regulate the spouses’ accommodation during the case. A request should explain current occupants, children’s needs, alternative housing, safety, ownership or tenancy and household expenses.

Temporary use does not itself decide final ownership or the matrimonial-property liquidation. Keep the requested interim order distinct from later financial claims.

Build an asset map before asking for restrictions

List real property, vehicles, accounts, company interests, valuable movables, debts and significant transfers with registration details and acquisition dates. Distinguish confirmed records from suspicions.

Explain how each asset connects to a legal claim: ownership dispute, contribution, residual-value participation, compensation or enforcement. A broad list without legal relevance can distract from an urgent, provable risk.

Provisional injunctions require a defined claim and risk

The Code of Civil Procedure permits provisional protection within its statutory conditions. The applicant should identify the right, the threatened change or difficulty, supporting evidence and the narrow order needed to preserve effective adjudication.

Courts consider proportionality and may address security and the consequences of an unjustified measure. Asset protection should not be framed as punishment or a general restraint on ordinary life.

Turkish measures and assets abroad

A Turkish order does not automatically bind a foreign bank, registry or company. For overseas assets, coordinate promptly with counsel in the asset country and avoid assuming that later recognition can recreate a missed local preservation opportunity.

Likewise, a foreign freezing or property order may require recognition, enforcement or a separate Turkish request before affecting a Turkish registry or debtor. Obtain the complete operative terms and finality or interim status.

Does a family-home annotation make me an owner?

No. It is a protective mechanism and does not by itself transfer title.

Can I remain in a home registered to my spouse?

Temporary use may be addressed during divorce, but the answer depends on the parties, children, safety, title or tenancy and the order made.

Can every asset be frozen during divorce?

No. A request must satisfy the legal conditions and be connected and proportionate to a defined claim and risk.

Will a Turkish injunction freeze a foreign account?

Not automatically. Immediate advice in the country where the account is held may be necessary.
