QUICK ANSWER

The legal position in one minute

Turkish interim and final maintenance orders can be enforced through the legally appropriate execution process. The creditor should calculate each due instalment, credit all payments and use the wording on currency, interest or increase. A foreign support order ordinarily requires recognition and enforcement in Türkiye before compulsory execution against Turkish assets. Modification is sought through the competent court; private non-payment does not by itself change the order.

Identify the enforceable obligation

Start with the signed or certified decision and its operative section. Record the type of maintenance, beneficiary, amount, commencement date, due date, duration, currency, increase clause, interest and whether the order is interim or final.

Do not rely on a message summarising the result. Protocol terms, hearing minutes and the final judgment may differ, and an enforcement office must act on an enforceable instrument.

Build a transparent arrears schedule

Create a month-by-month table showing amount due, adjustment, payment received, date credited and remaining balance. Separate principal, interest and costs. Bank transfers with unclear descriptions should be reconciled with contemporaneous messages and other obligations.

Overclaiming can create objections and costs; underclaiming can leave periods unresolved. The calculation should be reproducible from documents.

Enforcement tools and objections

The appropriate enforcement route depends on the instrument and obligation. Assets, bank accounts, wages or receivables may become relevant within statutory limits. Non-payment of maintenance can also have consequences distinct from ordinary debt, but procedural conditions must be met.

A payer may raise payment, calculation, identity or other legally available objections through the correct procedure. Ignoring an order because circumstances changed is unsafe; modification should be requested from the competent court.

Foreign support orders and Turkish assets

A foreign alimony or child-support order is not automatically executable against assets in Türkiye. Its finality or enforceability, service, jurisdiction, public policy, certified copy, authentication and Turkish translation must be reviewed under Law No. 5718.

Recognition of the divorce status alone may be insufficient. The monetary provision must receive the legal effect required for compulsory execution, after which the Turkish debtor and assets can be identified.

Increase, reduction and termination are separate claims

A substantial change in needs, income, care arrangements or other statutory circumstances may support increase, reduction or termination. The existing order remains the reference point until the court changes it or the obligation ends under its terms or law.

Preserve income, expense, school, health and payment evidence. Child support belongs to the child's welfare and should not be traded privately against contact.

Can unpaid alimony be enforced in Türkiye?

Yes, an enforceable Turkish order can be pursued through the appropriate execution process. The amount and procedural route must be calculated from the exact order.

Can the payer stop because income fell?

Not safely by unilateral decision. A change may justify a court application for reduction or termination, but the existing order should not simply be ignored.

Can a foreign child-support order be collected in Türkiye?

Potentially, after the required recognition and enforcement conditions are satisfied and Turkish assets or income are identified.

Can visitation be withheld for unpaid support?

Support and contact are separate. Private retaliation can harm the child and create additional legal issues.
