QUICK ANSWER
The legal position in one minute
An apostille verifies the origin of a public document under the 1961 Hague Convention; it does not translate the document, prove that a judgment is final or make every provision enforceable in Türkiye. A Turkish authority may also require a certified Turkish translation and a separate finality record. A divorce power of attorney should contain the necessary special authority and satisfy the authentication route applicable where it is signed.
01
Start from the act the document must prove
A marriage certificate proves a marriage record; a judgment records the court’s decision; a finality certificate proves the judgment reached the required final stage; an apostille authenticates the relevant public signature or seal; and a translation makes the content usable in Turkish. One document does not replace the others.
Ask which Turkish authority will receive the material and for what purpose: filing a divorce, recognition, civil registration, title transfer, child proceedings or enforcement. Requirements can differ even for the same foreign judgment.
02
What an apostille does—and does not do
Between states for which the 1961 Hague Convention is in force, an apostille replaces the traditional diplomatic legalisation chain for covered public documents. The competent authority in the country of origin issues it according to that country’s process.
An apostille does not confirm the facts or legal reasoning in the document. It does not convert a conditional order into a final order and does not remove the need for a Turkish translation. If the Convention does not apply, another consular or diplomatic legalisation route may be required.
03
Certified Turkish translation
The translation should cover the full operative document and any finality or authentication pages required by the receiving authority. Court names, dates, personal details and the exact order should be consistent. A summary prepared for convenience is not the same as a certified translation of the official document.
Keep the original and translation linked and in page order. Where the source contains an online verification code or digital signature, preserve the original electronic file and verification route.
04
Power of attorney for a Turkish divorce or recognition case
A Turkish consulate can often prepare a power of attorney in Turkish form. A foreign-notary document may instead require authentication and translation. Because divorce concerns personal status, the mandate should be reviewed for the required special authority and for the actual claims to be brought or defended.
The power of attorney should use names and identity details that can be matched to Turkish records. If a surname changed after marriage or divorce, include the documents that connect the records. Confirm whether photographs or additional formalities are required by the chosen issuing route before attending the appointment.
05
Finality and service are separate proof questions
A judgment may show a decision date without proving that appeals are exhausted or the order is final. Obtain the official record recognised by the issuing legal system. For a default judgment, also preserve evidence of summons, service and any appearance.
Turkish recognition can examine procedural fairness under the statutory conditions. A perfect apostille cannot cure the absence of a required final judgment or explain whether the opposing party received proper notice.
06
Ten-point document quality check
Before originals are sent, compare the spelling of names, former surnames, birth dates, marriage date, court, case number, decision date and finality date. Confirm that every seal, signature, apostille and translation is attached to the correct document.
Use secure delivery and retain a complete scan. Do not separate an apostille from the document it authenticates, laminate official documents without checking acceptability or write on the original pages.
- Correct person and all former names
- Correct marriage and case details
- Complete operative judgment
- Independent proof of finality
- Correct country-specific authentication
- Complete certified Turkish translation
DOCUMENT PREPARATION
Documents to organise before an initial review
Do not send originals until the receiving authority and required form have been identified. Begin with legible, complete copies and retain the source, page order and verification details.
- Official document in its complete original or accepted certified form
- Separate finality certificate or endorsement where needed
- Apostille or alternative legalisation attached to the correct document
- Complete certified Turkish translation
- Passport, identity and name-change records
- A case-specific power of attorney checked before signature
COMMON QUESTIONS
Questions international families often ask
Does an apostille make a foreign divorce valid in Türkiye?
No. It authenticates the public document’s origin. Registration, recognition or enforcement and certified translation may still be required.
Is an English document accepted without Turkish translation?
Do not assume so. Turkish courts and registries ordinarily require documents usable in Turkish, and the precise certification route should be checked.
Can I sign the power of attorney at a Turkish consulate?
A Turkish consulate is a common route. The proposed text and identity documents should be checked before the appointment.
Can I apostille a screenshot of an online order?
Usually the certifiable official document must first be identified. Preserve the original electronic record and follow the issuing country’s official certification and apostille process.
