QUICK ANSWER
The legal position in one minute
A foreign custody or contact order may require recognition or enforcement under Turkish private international law before coercive effect is sought in Türkiye. The applicant must distinguish recognition of legal effect, enforcement of a concrete obligation, a new Turkish child-welfare application and an urgent return request under the 1980 Hague Convention.
01
Begin with the legal effect required in Türkiye
Ask whether the order is needed as proof of parental status, to resist a conflicting claim, to compel delivery or contact, to update an official record or to support an urgent return application. Different objectives can require different procedures.
Translate the complete judgment, not only a certificate or selected page. The reasons may clarify habitual residence, jurisdiction, service and the scope of the operative terms.
02
Recognition compared with enforcement
Recognition concerns accepting the foreign judgment’s legal effect, while enforcement adds coercive effect to an executable obligation. A declaratory custody status and a detailed handover command should not be treated as identical remedies.
Law No. 5718 sets requirements and refusal grounds. The petition should connect each required document and fact to the statutory framework rather than relying on the foreign court’s title alone.
03
Finality, service and document integrity
Obtain the official judgment, proof that it is final or enforceable as required, valid service material, authentication and a complete certified Turkish translation. If the order is interim, expressly identify that status and obtain advice on the appropriate Turkish route.
Names, dates of birth and passport details should match. Explain later modifications, appeals and any order from another country so the court receives the current legal picture.
04
Current child welfare and changed circumstances
Recognition is not an opportunity to retry the entire foreign case, but child-related enforcement can raise present welfare and practical questions. Provide current residence, school, health, safety and contact information without disguising a new merits dispute as a document application.
If a fresh Turkish measure is needed because circumstances changed, plead the correct legal basis. The existence of a foreign order remains important but does not eliminate the need to identify jurisdiction and the relief now requested.
05
Foreign custody orders and Hague return cases
The 1980 Hague Convention addresses prompt return after wrongful removal or retention; it does not decide final custody. A foreign custody order may be relevant evidence of rights of custody but should not be confused with an automatically enforceable return command.
Act quickly where removal or retention is alleged. Record habitual residence, rights of custody, exercise of those rights, the move date, consent or acquiescence issues and every protective concern.
DOCUMENT PREPARATION
Documents to organise before an initial review
Do not send originals until the receiving authority and required form have been identified. Begin with legible, complete copies and retain the source, page order and verification details.
- Complete official foreign custody or contact order
- Certificate of finality or enforceability where required
- Proof of service and participation in the foreign case
- Apostille or applicable authentication
- Complete certified Turkish translation
- Current child residence, school, health and contact records
COMMON QUESTIONS
Questions international families often ask
Is a foreign custody order automatically enforceable in Türkiye?
Do not assume so. Recognition or enforcement and the required documents must be assessed under the applicable Turkish framework.
Is recognition the same as enforcement?
No. Recognition accepts legal effect; enforcement concerns coercive execution of an executable obligation.
Can the Turkish court reconsider the child’s current safety?
Child-related proceedings can require attention to present welfare, but the correct procedural route and scope must be identified.
Does a foreign custody order guarantee return under the Hague Convention?
No. It may be relevant, but the Convention has its own requirements, exceptions and return analysis.
