The legal position in one minute

Turkish divorce courts can assess witness evidence, messages, photographs, medical and police records, financial material, expert reports and other lawful proof. Admissibility and weight depend on how the material was obtained, whether its source and integrity can be shown and what disputed fact it proves. Unauthorised access, covert monitoring and edited excerpts create serious risk.

Match each item to a disputed fact

Start with a table containing the date, event, legal relevance, opposing position and available source. This reveals gaps and prevents hundreds of pages of material from obscuring the few facts that matter.

A message may show language used but not who controlled the account; a payment may show money moved but not why. Evidence should be evaluated individually and together with corroborating facts.

WhatsApp, email and social-media material

Preserve the full conversation, account identifiers, dates and the original device or export where possible. Cropped screenshots can conceal context and are easier to dispute. Explain how the party lawfully obtained the material.

Being married does not grant unrestricted authority to enter a spouse's private account, guess a password or install monitoring software. Seek advice before collecting data from a device or service not under your lawful control.

Witnesses and institutional records

A witness is most useful when describing what they personally saw or heard, with time and place. Repeating what a spouse later said carries different weight. A concise witness list should identify the event each person can prove.

Medical records, police reports, protection orders, school records, employment documents, bank material and official correspondence can provide dated corroboration. The court may need to obtain protected or institutional records through formal channels.

Audio recordings, photographs and privacy

Secret audio or video evidence requires particular caution. Planned, systematic recording of private life can be unlawful; exceptional circumstances are fact-sensitive and should never be assumed from an online example.

Keep original files and metadata and avoid editing, captions or repeated forwarding. Publishing private material on social media is different from presenting potentially relevant evidence through lawful court procedure.

Foreign-language and overseas evidence

Foreign documents may need certification, authentication and complete Turkish translation. Names, dates, case numbers and issuing authorities should be consistent across the original and translation.

If evidence must be obtained from a foreign authority or platform, identify the lawful route and lead time early. A Turkish case deadline does not automatically compel a foreign holder to produce material informally.

Documents to organise before an initial review

Do not send originals until the receiving authority and required form have been identified. Begin with legible, complete copies and retain the source, page order and verification details.

There is no safe universal answer. Privacy, criminal-law and procedural rules depend on how and why the recording was made; obtain advice before relying on it.

Should I send every document with the first message to a lawyer?

No. Begin with a chronology and a secure, organised inventory. Avoid sending unnecessary identity, health or children's data through casual messaging.

Do foreign documents need translation?

Formal Turkish proceedings generally require usable Turkish material. The necessary certification and authentication depend on the document and issuing country.
