What an English-language first review should establish

A useful first review starts with a country-and-date map. It records every nationality, current residence, the last shared home, the place and date of marriage, the children's habitual residence, existing court files and the location of significant assets. This prevents a familiar legal label from hiding the actual cross-border problem.

The immediate decision may be whether to file in Türkiye, answer an existing case, seek interim protection, preserve evidence, recognise a foreign judgment or obtain documents first. The correct sequence matters because a second proceeding, defective service or inconsistent relief can create avoidable delay.

Divorce, children, support and property are separate workstreams

The divorce status does not automatically resolve custody, contact, maintenance, compensation or matrimonial property. Each claim has its own legal basis, evidence and requested order. International files may also require a separate applicable-law and recognition analysis for each workstream.

Where a party must speak at a hearing, interpreter arrangements may be required. A bilingual explanation of a settlement protocol is particularly important because consent should be informed and the Turkish text will control the court filing.

Can a Turkish lawyer act while the client remains abroad?

Many procedural steps can be handled under a properly drafted power of attorney issued through a Turkish consulate or another accepted document route. The required authority depends on the case and should be checked before the document is signed, legalised and translated.

Personal attendance is not eliminated in every case. An uncontested divorce requires the judge to hear both spouses personally, and a court may require participation for evidence or clarification. Travel should be planned only after the procedural need and hearing format are confirmed.

Questions to ask before instructing counsel

Ask who will handle the file, what work the quoted fee covers, which costs are separate, how updates will be provided and which foreign-law questions require counsel in another jurisdiction. A written scope is more useful than broad assurances about speed or success.

For a live case, provide the full petition, service envelope or electronic notification and every approaching date. Conflict checks and document review should take place before confidential strategy is discussed in detail or a representation relationship is assumed.
