The legal position in one minute

Divorce does not produce one universal immigration result. A family residence permit may need reassessment under Law No. 6458, while Turkish citizenship acquired validly is governed by Law No. 5901 and is not simply cancelled because a marriage later ends. A pending citizenship-by-marriage application and an already acquired citizenship require different analyses.

Three decisions made under different laws

The family court decides the divorce and related family claims. Migration authorities administer residence permissions, while citizenship is governed under its own statute and administrative process. One decision may trigger notification or reassessment without allowing another authority’s legal test to be skipped.

Family residence permits after separation or divorce

Law No. 6458 contains rules for family residence permits and circumstances in which a short-term permit may be available after divorce. Duration of residence, domestic violence findings and other statutory facts can matter.

Do not rely on a general statement that the permit ends immediately or always continues. Review the permit card, residence history, divorce status, safety record and latest official migration guidance before the next filing or travel.

A pending citizenship-by-marriage application

Marriage to a Turkish citizen does not itself confer citizenship. Law No. 5901 sets conditions for an application based on marriage, and the continuation and genuineness of family unity are examined within the statutory framework.

A separation, divorce filing or final divorce can therefore affect a pending application’s factual basis. Statements to the court and citizenship authority should be accurate and consistent.

Citizenship already acquired

Citizenship validly acquired is not automatically lost merely because the marriage later ends. Loss or cancellation questions arise under the citizenship statute and should not be confused with the ordinary consequence of a divorce decree.

If authorities allege false information or concealment in the original process, obtain the complete administrative file and specialised advice. That dispute is distinct from ordinary marital fault.

Children, passports and travel planning

A parent’s immigration position does not decide custody or permission for a child’s international move. Review custody orders, the child’s nationality, habitual residence, passport position and any travel restriction separately.

Before leaving Türkiye during a dispute, confirm the legal authority for the child’s travel and the immigration status needed for return. An unauthorised cross-border move can trigger urgent family-law proceedings.

Citizenship validly acquired is not automatically lost solely because the marriage later ends. Separate statutory grounds govern loss or cancellation.

Can I complete a citizenship-by-marriage application after separation?

The authority assesses the statutory conditions and current facts. A pending application should be reviewed promptly and accurately updated where required.

Does my residence status decide child custody?

No. Immigration circumstances can affect practical care, but custody is determined under the child-welfare framework.
