Humanitarian residence is a special route under Article 46 of Law No. 6458. It should be assessed against a documented statutory ground rather than treated as an automatic alternative after a tourist-residence refusal.
Identify the statutory ground
The best interests of a child, circumstances preventing or making departure unreasonable, and other listed grounds require an individual assessment. Humanitarian residence and international protection are different legal regimes. Explain the facts and identify which statutory provision applies.
Evidence and competent authority
Prepare a chronology with identity, family, medical or travel documents relevant to the ground relied on. The provincial migration authority handles the residence process within the applicable approval framework. An ordinary e-İkamet record alone does not establish eligibility for humanitarian residence.

Duration, costs and continuing obligations
The period granted and conditions attached must be read from the decision and current law. A residence card does not itself grant a work permit. Official charges, any exemption and the applicable address obligations need to be checked for the individual case.
Refusal, cancellation and legal assistance
Obtain a reasoned written decision and its notification record. If a separate deportation or detention decision exists, its challenge procedure must also be assessed. New evidence, a change in circumstances and a court application serve different purposes.

Frequently asked questions
Does every residence refusal create humanitarian eligibility?
No. A statutory humanitarian ground must be assessed on the individual facts.
Can I work with this residence card?
The residence card alone does not authorise employment; work-permit rules must be examined separately.
General information. It does not replace an assessment of your individual case.
